Our sales are subjected to the present general
conditions which prevail on any other stipulation emanating of the
purchaser. Any order addressed by the purchaser carries his
adhesion without restriction nor reserve on the present general
conditions of sale.
Orders
The orders placed by the intermediary of the Web
site engage the purchaser as of the acceptance of order given by the
purchaser on the Web site.
Information, photographs and graphics of the catalogues are only
indicative and engage the merchant by no means.
From the moment when the Customer recorded his order, it is
considered having accepted with full knowledge of the facts and
without reserve the prices, volumes and quantities proposed with the
sale and ordered.
Price
The selling prices of the products are those in
force at the time of the recording of the order other than the
transport charges.
The selling prices of the products can be modified constantly by
the occurence of external events.
The forwarding costs are the responsibility of the Customer and
are invoicees in supplement of the price of the products according to
the amount of the order.
The forwarding costs will be indicated to the recording of the
order by the Customer.
Payment
Except particular stipulation, the products are
payable with the order. Any sum paid by the Customer before the
delivery of the product constitutes an installment on the selling
price definitively had by the Customer.
Penalties of an amount equal to the raised bank base rate of 3
points are applicable full to the unpaid amounts at the end of a 10
days deadline following the date of invoicing or as of the
notification of the banking rejection of payment for any other means
of payment. The delivery of all new order could be suspended in
the event of delay of payment of a preceding order.
Delivery
The delivery famous is carried out as of provision
of the product to the Customer. It is up to the Customer to
check forwardings with the arrival and to make all reserves and
complaints which would appear justified.
If the delivered products are not in conformity in kind or in
quality with the specifications indicated in the delivery order, the
Customer must, hardly of forfeiture, to formulate his complaints in
the eight (8) days after delivery.
Delivery choice :
Ship and Backorder
This selection will allow us to ship all in stock products to you immediately and backorder any items which are not in stock.
Any Backordered items will ship the next day if the products are in stock at our other warehouse, or as soon as either warehouse receives stock from our suppliers.
Hold and Ship complete
This selection tells us to hold your entire order until all items are in stock.
This will allow for all items on your order to ship at one time, but it can also cause indefinite delays in shipment if any items is not in stock and delivery from our suppliers is delayed.
Reserve property
The salesman preserves the property full and whole
market products until the perfect payment of the price, the main
thing, expenses and inclusive of tax.
The transfer of the risks relating to the product will be
carried out at the time of the handing-over to the conveyor of the
ordered product. It thus rests to the Customer to contract with
his expenses, an insurance, in order to cover any risk, in particular
degradation and loss.
Guarantees
The market products profit from a guarantee of the
manufacturer. Are excluded from this guarantee, all produced
modified or repaired by the purchaser or any other unauthorized person
expressly by the salesman, like all the products being the subject of
a contract of specific assistance and maintenance.
Any return of the product to the above mentioned guarantee
voucher must be the subject of prior agreement by the salesman.
For this purpose, the purchaser will contact the after-sales
service of the salesman by formulating his request by electronic mail.
If the product is recognized like defective, the salesman will
transmit to the purchaser a number of return of product. The
defective product must be turned over in its packing of origin and be
accompanied by the number of return of product communicated by the
salesman. All the expenses and risks related to the return of
the product are the responsibility of the purchaser.
Responsibility
The salesman could not see his committed
responsibility with some title that it is for any consequential
damage. In the event of direct damage, the responsibility for
the salesman is limited to a maximum amount for 10 000 francs.
Attribution of jurisdiction
The present general conditions of sale are
controls by the French right. For all the disputes relative to
the present contract between the salesman and the purchaser, the
commercial court of Valenciennes will be only qualified.
Data processing and Freedoms
Pursuant to the data-processing law and freedoms
of January 6, 1978, the Customer has a right of access and of
correction to the data relating to it and preserved by the merchant.
